ONLINE DEPOSIT
A non-refundable deposit in the amount of $100.00 is required at the time of booking the event date online. The deposit secures the event date and times for the client. The downloadable content purchased with the deposit is a digital pdf copy of these terms and a copy of our requirements and requests sheets. A contract will be e-mailed within 14 days of deposit to outline any other options or possible fees.
A refund of the deposit will only be issued if it is found that Check THIS Out presents Bobby Austin Music is previously engaged for your desired date.
BALANCE DUE
Balance paid is non-refundable 60 days or less prior to the event. All cancellations must be placed in writing and sent via mail or e-mail. DJ services will not begin until the balance is paid in full. Payment for any overage in time must be paid before additional hours are provided.
DJ SERVICE OPERATIONS
Check THIS Out agrees to have the DJ service and Karaoke (optional) operational for the time period specified; however, in some situations operations may need to be interrupted for maintenance, service and/or sound optimizations. Check THIS Out agrees to have a qualified DJ onsite to maintain and operate all equipment. Should Check THIS Out fail to provide a fully operational DJ service during the agreed upon times, the client’s only remedy is a refund of payment received. Client agrees that Check THIS Out will not be responsible for consequential damages. If only partial services can be provided due to conditions beyond our reasonable control, then the charges shall be on a prorated basis.
DJ SERVICE SETUP/TEARDOWN
Check THIS Out will setup and remove the DJ equipment from event location. Operation of DJ service times may be adjusted if event location or client ends the event prior to the contracted end time and no refund of money will apply. The area where the DJ is to be set up is reasonably accessible and has level ground. Check THIS Out requires access to venue at least 60 minutes before the event and at least 60 minutes after the event for setup and takedown.
SPACE & PLACEMENT REQUIREMENTS
Client agrees to provide: (1) A minimum 7’ wide x 7’ long x 7’ tall area for our DJ service
(4-6) 110V, 20 amps, 3 prong standard electrical outlet within 20 feet of our designated area.
SAFETY PROVISIONS
While Check THIS Out strives for excellence and wishes to follow the Client’s direction at all times, our DJs reserve the right to conclude any entertainment or announcements in the event the Check THIS Out DJ feels threatened or unsafe. In such case that an engagement is concluded/ended early because of threatening or aggressive behavior, it is understood the event will be considered “Paid-In-Full” and no refund will be tendered.
INCLEMENT WEATHER
Check THIS Out reserves the right, in good faith, to cease the operation should the weather pose a potential danger to our personnel, the equipment, or guests. Since safety is paramount in all decisions, Check THIS Out compensation will not be affected if operation is ended.
LIABILITY AND INDEMNIFICATION
Check THIS Out shall not be liable under any contract for direct, indirect, incidental or consequential damages (including without limitation, damages for lost profits or increased expenses) with respect to any claim arising from or related in any way to this agreement and services provided. The Client will indemnify and hold harmless Check THIS Out and any DJ service attendants who are independent contractors working with Check THIS Out at the time against any and all liability related to Client's Event from the time of service and on into the future. Client will assume all legal fees claimed by third persons, provided that such loss or damage was not caused by the fault or negligence of Check THIS Out or its employees, agents, or subcontractors.
DAMAGE TO CHECK THIS OUT EQUIPMENT
Client acknowledges that it shall be responsible for any damage or loss to the Check THIS Out equipment caused by: a) any misuse of the equipment by Client or its guests, or b) any theft or disaster (including but not limited to fire, flood or earthquake). c) loss of power or power surges to the DJ equipment at any time resulting in loss of music or damage of software and/or equipment. Repair, replacement, or financial agreements within 30 days of incident are the only acceptable terms.
ETHICAL PROVISIONS
The Client shall, at all times, have complete supervision, direction, and control over the Check THIS Out DJ for the engagement stated above understanding that the Check THIS Out DJ will, at no time, jeopardize themselves or the company owned equipment by the direction of anyone including the Client. It is up to the Check THIS Out DJ’s discretion to reject announcements or any other request that goes against their religious or political views, race, creed, sexual orientation or character.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforce-ability of any remaining provisions, or portions thereof. This is the entire agreement between Check THIS Out and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to solve any arguments via arbitration. This agreement constitutes the entire agreement and supersedes all prior oral, written and other agreements between the parties with respect to the subject matter hereof. This Agreement may only be amended in writing signed by Check THIS Out and Client.
